Where AI can genuinely help family practitioners (and where it absolutely should not be used).

Family law sits at the sharp end of human emotion:

  • relationship breakdown;
  • children and safeguarding;
  • money, housing and long-term security.

AI tools can help family practitioners with forms, chronologies and communication, but they also raise particular risks around confidentiality, vulnerable clients and tone.

This article looks at where AI can genuinely help in family practice — and where you should draw firm red lines.

1. Where AI can safely lighten the load

Some family work is relentlessly administrative. AI can help with:

  • Form support – drafting answers or explanations for applications based on structured information you already hold (for example, background summaries you have written yourself).
  • Chronologies – turning long email threads and notes into timelines of key events (separation, incidents, court hearings, contact arrangements).
  • Standard letters and updates – drafting first-pass client updates, letters to the other side and cover emails.

In each case, the safest pattern is:

  • you provide the facts (from your own notes, not directly from highly sensitive raw messages);
  • AI helps organise and express them;
  • you review, edit and decide what to send or file.

AI should never be the first person to hear something important; that should still be you.

2. Handling vulnerable clients and sensitive narratives

Many family clients are:

  • distressed;
  • unfamiliar with legal language; and
  • anxious about being judged.

AI can help by:

  • simplifying explanations (“What does a prohibited steps order do?”);
  • suggesting plain-language descriptions of court processes;
  • helping you translate complex court orders into client-friendly action lists.

But there are clear red lines:

  • Do not let AI interrogate trauma – clients should not be asked to “tell their story to the chatbot”. Those conversations belong with trained humans.
  • Do not treat AI as a counsellor – signpost clients to appropriate support services instead.
  • Be careful with tone – AI outputs can sound glib or minimising if not checked carefully.

A useful rule is that AI may help you explain what is happening; it must not replace your own empathy and professional judgment.

3. Children, safeguarding and red lines

Where children and safeguarding are involved, caution levels should go up.

Sensible limits include:

  • no use of open, consumer-grade AI tools for case-specific details;
  • using only approved systems where data stays within tightly controlled environments;
  • avoiding the inclusion of highly sensitive personal data unless strictly necessary for the task.

For example, AI might help you:

  • summarise a directions order in neutral terms;
  • extract key dates and hearings into the matter chronology;
  • prepare a structured checklist of steps before a key hearing.

But it should not be allowed to:

  • “rephrase” allegations in a way that changes nuance or seriousness;
  • invent or embellish incidents;
  • generate advice without human editing (“you should do X about contact arrangements”).

4. Financial remedy work: documents and disclosure

Financial remedy cases produce large volumes of:

  • bank statements;
  • disclosure forms (Form E and supporting documents);
  • valuations and reports.

AI can assist with:

  • extracting transactions above certain thresholds;
  • identifying patterns (regular transfers, loans, payments to third parties);
  • creating simple tables of assets, liabilities and income sources from documents you already have.

Here, AI is a pattern spotter and table-builder. You still decide:

  • what is suspicious or incomplete;
  • which explanations to seek;
  • what advice to give about settlement or further disclosure.

5. Confidentiality, privilege and domestic abuse

Family files often contain extremely sensitive information about:

  • domestic abuse, coercive control and safeguarding concerns;
  • mental health, addiction and medical histories;
  • children’s schools and locations.

When using AI:

  • stick to tools approved under your AI and confidentiality policies;
  • minimise the data you send (for example, refer to “the other parent” rather than full names if the identity is not needed for the task);
  • prefer systems where prompts and outputs are not used to train general models.

It can help to have simple internal guidance such as:

  • “No raw safeguarding notes or domestic abuse narratives into AI tools — summarise them yourself first, then use AI to help structure your own wording if needed.”

6. Explaining AI use to clients and the court

Clients increasingly ask whether you are using AI on their cases. Courts and regulators may do the same.

A calm explanation might be:

  • “We sometimes use AI tools to help summarise documents or draft first-pass letters, but a solicitor always checks and finalises anything we send or file.”
  • “We do not use AI as a substitute for legal advice or for deciding what is best for you or your children.”

Internally, you should be able to show:

  • where AI was used on a matter;
  • who checked its outputs;
  • what systems and safeguards were in place.
